APPEAL COURT JUDGEMENT: LABOUR PARTY APPROACHES SUPREME COURT

ABEOKUTA – The Court of Appeal Ibadan, on Monday struck out the Labour Party’s application second Appeal against the  judgment of the ogun state Governorship election Petition Tribunal delivered on the 21st June 2019. 

The Labour Party had brought an application in Appeal No CA/IB/EPT/OG/GOV/M/2019 seeking the leave of the Appeal Court for extension of time to appeal against the Tribunal judgement in favour of the Governor Abiodun and APC.

The respondents counsel had challenged the jurisdiction of the appellate court on the ground that the Applicants are out of time to appeal against the decision they seek to challenge and that the application is academic as the jurisdiction of the court is already abated before the said application was brought before it.

Their Lordships (Hon. Justices Jimi Olukayode Bada, H.T  Tsammani and O Okoronkwo ) while dismissing the application, also warned the counsel to the Labour Party to abide by ethics of the profession by guiding against future abuse of court processes by way of frivolous application.

But Labour Party has finally made the move to consolidate its ongoing suit at the Supreme Court.

This has now brought the suit over the official omission of the Logo of LP on the 2019 Governorship election in Ogun State in March 2019 together with the Justice HALILU  Yussuf judgement made on 21st June and 13th July all now before the Supreme Court, Abuja.

“The public is hereby informed of the progress and position of the suit to avoid the usual style of the respondents and their men – Friday from misinforming the public or in their common and habitual style give a very wrong interpretation to the dismissal of the suit at the Appeal Court .

“It is usual for appeals to be struck out for a reason to enable for existing suits on the same subject and particulars to be consolidated in law.

“We in LP thank the public for standing for justice and fair play . LP Ogun State assures the Public that , this one case will be pursued to a thinkable conclusion logically.  Labour Party is strongly confident in our Judiciary and are confident that in this one case justice shall be done .

“Ogun Labour Party is determined and very much given to pursuing this one sure banker case to its very thinkable conclusion . Our trust in the Judiciary is unshaken and solid . It is beyond doubt what the law says when the name of a Contestant is ommitted on the ballot paper for an election held with that ommision .

“With the RULLING of today at the court of appeal, the respondents should be prepared for a shocking nightmare at the Supreme Court . The suit is unique because , it is very difficult to defend in a free and fair trial.”
