A federal high court, Abeokuta, has dismissed an application filed by the Ogun State PDP, to stay the Execution of the last September 28 court’s order, cancelling its primary elections for the 2023 polls.
Justice Oluwatoyin Oguntoyinbo in the September 28 judgement, also ordered the state PDP executive committee to conduct fresh primaries within 14 days, which lapsed last Tuesday.
During the Thursday’s hearing of the PDP application, Muyiwa Obanewa, the lead counsel to Honorable Ladi Adebutu, the party’s governorship candidate, told the court he was abandoning the application.
The counsel said he would apply for the withdrawal of the application, because he was about to complete the process of challenging the ruling at an appeal court.
Counsel for the aggrieved delegates, Dr. Kemi Pinhero asked the court to award a cost to his client, because he had filed a response to the application filed by the plaintiff.
But Deji Enishehin, counsel to the APC Governorship Aspirant, Otunba Jimi Lawal, called for the dismissal of the application.
He contends that the application was dead on arrival, since the independent national electoral commission had complied with the September 28 judgement by not listing Adebutu as the PDP governorship candidate.
In her judgement, Justice Ogintoyinbo dismissed the PDP application, but refused to award cost against the party.
